Membership Agreement

Effective For: Fit&Well Website, iOS & Android Apps


1. Introduction

This Membership Agreement (“Agreement”) outlines the rights and responsibilities between Fit&Well (“We,” “Us,” “Our”) and the Member (“You,” “Your”) in relation to the use of our facilities, services, and digital platforms.

By signing up or using the Fit&Well website, app, or any in-club services, you agree to all terms stated in this Agreement, along with our Terms & Conditions, Privacy Policy, and Refund & Cancellation Policy.


2. Membership Overview

Fit&Well offers a range of memberships that provide access to fitness, wellness, and recovery services, including but not limited to:

  • Gym access and personal training

  • Cryotherapy, hydrotherapy, and recovery treatments

  • Group classes and workshops

  • Health and wellness assessments

  • App-based booking, tracking, and communication tools

Membership options may vary by duration, facility type, and included benefits.


3. Membership Eligibility

  • Members must be 18 years or older.

  • Individuals under 18 require written consent from a parent or legal guardian.

  • Fit&Well reserves the right to refuse or revoke membership at its discretion if eligibility or conduct standards are not met.


4. Membership Activation

  • Memberships commence upon full payment or confirmation of installment plan setup.

  • Digital membership cards are issued via the Fit&Well App and are non-transferable.

  • Your access rights begin immediately after activation unless otherwise stated in your plan.


5. Payment Terms

  • Membership fees are payable upfront or as per the agreed installment schedule.

  • All prices are listed in AED (United Arab Emirates Dirhams) and inclusive of applicable VAT.

  • Payments can be made through approved channels — in-app, at the club, or via recurring billing.

  • Late or failed payments may result in suspension or cancellation of your membership.

Fit&Well reserves the right to revise membership rates with prior notice.


6. Duration, Renewal & Expiry

  • Memberships are valid for the duration selected (e.g., 1 month, 3 months, 6 months, 12 months).

  • Renewal is not automatic unless authorized via your app or signed agreement.

  • Expired memberships will lose access to facilities until renewed.


7. Freeze & Pause Options

You may request to freeze or pause your membership for valid reasons such as:

  • Travel (more than 14 consecutive days)

  • Medical leave (with supporting documentation)

Freezes must be requested at least 5 days before the intended pause date and are subject to approval.
A freeze cannot exceed 90 days per year.


8. Cancellation by Member

  • Memberships can be cancelled before renewal.

  • Early termination fees may apply depending on your membership type and duration.

  • Refunds are processed as per the Refund & Cancellation Policy.

9. Cancellation by Fit&Well

Fit&Well reserves the right to terminate your membership immediately if:

  • You violate club policies, safety standards, or UAE laws.

  • You misuse equipment or behave inappropriately towards staff or members.

  • You fail to pay fees after multiple reminders.

In such cases, refunds will not be issued for remaining membership duration.


10. Facility Usage Rules

  • Check-in via the Fit&Well App or front desk is mandatory.

  • Proper workout attire and footwear must be worn at all times.

  • Members are expected to maintain personal hygiene and cleanliness.

  • Equipment should be used responsibly and returned to its place after use.

  • Smoking, alcohol, or prohibited substances are strictly banned.

Failure to follow these rules may result in suspension or termination.


11. Health & Safety Declaration

By becoming a member, you confirm that:

  • You are medically fit and have no condition that prevents safe participation.

  • You understand that physical exercise and treatments carry inherent risks.

  • Fit&Well and its staff shall not be held liable for injuries, accidents, or health issues arising from your participation.

  • You will immediately notify staff of any medical emergency or discomfort.


12. Personal Belongings

Fit&Well provides lockers for your convenience.
However:

  • We are not responsible for loss, theft, or damage to personal items.

  • Members are advised not to leave valuables unattended.


13. Code of Conduct

Fit&Well promotes an atmosphere of respect and community.
Members are expected to:

  • Treat staff and fellow members with courtesy.

  • Avoid loud, abusive, or discriminatory behavior.

  • Use facilities responsibly and ethically.

  • Follow all instructions from trainers and staff.

Repeated violations may lead to membership revocation.


14. Digital Account & App Usage

  • Members must keep login credentials confidential.

  • Any unauthorized access or misuse of the app will lead to suspension.

  • Notifications may be sent to your registered email or device for updates, offers, or reminders.

  • Fit&Well reserves the right to update app features and membership functionalities at any time.


15. Liability Waiver

You agree that:

  • Fit&Well, its owners, employees, and affiliates are not liable for personal injuries, accidents, or losses incurred while using our services or facilities.

  • Participation in physical or wellness activities is entirely voluntary and at your own risk.

  • You release Fit&Well from any claims or damages arising from your use of the club or its app.


16. Privacy & Data Use

Your personal data is handled in accordance with the Fit&Well Privacy Policy.
We use encrypted systems and secure cloud storage for data protection, including Zoho CRM infrastructure.


17. Intellectual Property

All content, brand names, and materials (including “Fit&Well”) are proprietary.
You may not reproduce, copy, or use any of these without written permission.


18. Governing Law & Jurisdiction

This Agreement shall be governed by the laws of the United Arab Emirates, and any disputes will be subject to the exclusive jurisdiction of the Dubai Courts.


19. Acknowledgment

By accepting this Membership Agreement:

  • You confirm you have read, understood, and agreed to all terms.

  • You authorize Fit&Well to store and process your data for membership and service purposes.

  • You agree that this Agreement is binding electronically without the need for a physical signature.
