1. Acceptance of Terms
By accessing or using the Fit&Well website, mobile application, or any related services, you agree to be bound by these Terms & Conditions (“Terms”). If you do not agree, please do not use our services.
Fit&Well reserves the right to update, modify, or replace any part of these Terms at any time. Continued use of the platform after any such changes constitutes acceptance of the updated Terms.
2. Nature of Service
Fit&Well is a premium fitness, wellness, and recovery ecosystem offering membership-based access to:
Fitness classes, gym sessions, and wellness programs
Recovery and therapy services (e.g., cryotherapy, massage, hydrotherapy)
Coach and staff-led training sessions
Online and in-app member engagement tools (bookings, credits, rewards, etc.)
All services are managed through Zoho-powered CRM systems for scheduling, billing, and membership management.
3. Eligibility
You must be:
At least 18 years old, or using the services under the supervision of a parent or legal guardian.
Medically fit to participate in physical activities and wellness treatments.
Fit&Well reserves the right to request proof of age or medical clearance at any time.
4. User Account
To access certain features, you must register and maintain an account:
You are responsible for maintaining the confidentiality of your login credentials.
Any activity occurring under your account will be deemed your responsibility.
You must provide accurate, current, and complete information.
Fit&Well reserves the right to suspend or terminate accounts that violate these Terms or any applicable laws.
5. Bookings & Cancellations
Bookings for classes or services can be made via the app or reception.
Cancellation policies vary per service; late cancellations or no-shows may result in a charge or deduction of credits.
Repeated late cancellations may lead to temporary suspension of booking privileges.
Fit&Well reserves the right to reschedule or cancel sessions due to operational reasons or unforeseen circumstances.
6. Payments & Billing
All payments (membership fees, class credits, or service purchases) must be made through approved payment methods within the app or at the club.
All prices are displayed in AED (United Arab Emirates Dirhams) unless otherwise specified.
Membership and service fees are non-refundable, except where required by law or at Fit&Well’s sole discretion.
Any taxes, VAT, or surcharges applicable under UAE law will be added to your total.
7. Health Disclaimer
You acknowledge that participation in fitness or wellness activities carries inherent risks.
You agree to consult a qualified medical professional before using any Fit&Well facilities or services.
Fit&Well and its staff are not responsible for any injuries, medical conditions, or adverse reactions resulting from participation in our activities or treatments.
8. Facility Rules & Code of Conduct
To ensure a safe and enjoyable experience:
Always check-in at reception or through the app before using any facility.
Respect the privacy and comfort of other members.
Proper attire, hygiene, and conduct are mandatory.
Use equipment responsibly and follow coach or staff instructions at all times.
Fit&Well reserves the right to refuse entry or terminate membership for misconduct, damage to property, or non-compliance with club rules.
9. Intellectual Property
All content, design, software, images, videos, and trademarks (including “Fit&Well” and related logos) are the exclusive property of Fit&Well or its licensors.
You may not reproduce, distribute, or modify any content without prior written consent.
10. Mobile App Usage
When using the Fit&Well app:
You grant permission for the app to send notifications, reminders, and offers related to your account.
App functionality depends on internet connectivity and device permissions.
Unauthorized use, reverse-engineering, or tampering with the app is strictly prohibited.
11. Privacy & Data Protection
Your data is handled per the Fit&Well Privacy Policy.
We use industry-standard encryption and Zoho’s secure API infrastructure to protect your information.
Personal data is never sold or shared with third parties without consent, except as required by law.
12. Termination
Fit&Well reserves the right to:
Suspend or terminate any account for breach of Terms or misuse of the platform.
Deny access to any user who acts abusively or fraudulently.
Retain transaction and activity data as required by UAE law, even after account deletion.
13. Limitation of Liability
To the fullest extent permitted by law:
Fit&Well shall not be liable for indirect, incidental, or consequential damages resulting from the use or inability to use our services.
Fit&Well does not guarantee that the website or app will be uninterrupted, secure, or error-free.
14. Indemnification
You agree to indemnify and hold harmless Fit&Well, its employees, partners, and affiliates from any claims, damages, or losses arising from your use of the services or violation of these Terms.
15. Governing Law & Jurisdiction
These Terms are governed by the laws of the United Arab Emirates.
Any disputes shall be subject to the exclusive jurisdiction of the courts of Dubai, UAE.

By using the Fit&Well website or app, you confirm that you have read, understood, and agreed to these Terms & Conditions in full.
Invitations and Referrals
Fit&Well allows users to invite friends, family, and colleagues to join the Fit&Well community through our in-app referral feature. To enable this, users may enter limited personal details of the person they wish to invite — such as name, phone number, or email address — solely for the purpose of sending that invitation.
Before submitting any invitation, users are required to confirm that they have obtained consent from the person being invited. Fit&Well does not independently collect or verify consent from the invitee; the responsibility lies with the referring user to ensure that the invited person has agreed to receive the invitation.
How We Use Referral Data
The invitee’s contact information is used only once to send the invitation.
We do not store, sell, or reuse invitee data for any marketing or unrelated purposes.
If an invitee chooses to join Fit & Well, their personal data will then be collected directly from them, with full consent, under our standard user registration process.
If an invitee chooses not to participate, they may ignore the invitation or request deletion of their information at any time by contacting us at .
User Responsibility
By using the referral feature, the user confirms that:
They have obtained explicit consent from the person they are inviting.
They understand that they are solely responsible for sharing any third-party information in compliance with applicable data protection laws.
Legal Compliance
This process is designed in accordance with App Store Review Guideline 5.1.2 and relevant global privacy standards (including GDPR and UAE data protection principles) to ensure the lawful and transparent use of personal data.
